Terms of reference

Background

Benin’s Law No. 2013-01 on the Land and Property Code and Law No. 2002-07 on the Code of Persons and the Family recognise women’s equal access to land and inheritance. In rural areas their application remains weak and customary rules still govern most access to land. The consortium needs solid, current evidence for its advocacy towards the National Agency for Land and Property (ANDF), sector ministries and municipalities.

Objectives

  1. Measure the gap between the rights set out in the two codes and their actual application.
  2. Identify legal, administrative, economic and sociocultural barriers, including intersecting discrimination linked to age, disability and marital status.
  3. Analyse access by women and their cooperatives to green financing and environmental grant schemes.
  4. Formulate precise advocacy recommendations for ANDF, sector ministries and municipalities.

Methodology

  • Review of data from the Directorate of Agricultural Statistics (DSA) and ANDF.
  • Survey of 300 people, at least 70% rural women, disaggregated by age, disability and marital status, across the four municipalities.
  • Focus groups with women’s groups; interviews with elected officials, municipal land offices, customary authorities, microfinance institutions and technical services.
  • Collection in local languages, informed consent, protection of data and people.
