Botswana: women’s rights and civic space laws

Botswana’s Constitution prohibits discrimination, but the CEDAW Committee noted in 2025 that family law does not cover divorce and debt and that women are not awarded equal inheritance under State law. Abortion is allowed only on limited grounds, and consensual same-sex relations were decriminalised by court decision, upheld by the Court of Appeal in 2021. Women hold 9% of seats in the National Assembly after the October 2024 election and there are no electoral quotas. In June 2025 Botswana told the CEDAW Committee it ratified the Maputo Protocol in December 2023, while a Domestic Violence Act revision and an Employment and Labour Relations Bill with workplace sexual harassment provisions were under way.

The Public Service Act makes sexual harassment a punishable offence for public servants; the Bill would cover workplace sexual harassment more broadly.

The ruling found the citizenship law discriminatory and allowed women to pass citizenship to their children. Male and female foreign spouses can obtain citizenship after 5 years’ residence.

Data Protection Act No. 18 of 2024
Replaces the Data Protection Act 32 of 2018 and strengthens data subject rights. It requires breach notification within 72 hours and parental consent for children under 16 online.
Gaps: Commissioners of the Information and Data Protection Commission are appointed by the President, which raises independence concerns.
