Zambia: women’s rights and civic space laws

Zambia has made several recent legal reforms for women and girls: the Marriage (Amendment) Act No. 13 of 2023 set 18 as the minimum age for all marriages including customary ones, and the Constitution (Amendment) Act No. 7 of 2025 created 20 proportional-representation seats reserved for women from the August 2026 election. Women held only 15% of National Assembly seats before that election, and Article 23 of the Constitution still allows discrimination in personal and customary law. The CEDAW Committee found in 2011 that marital rape was not explicitly criminalised.

Gaps: The CEDAW Committee noted marital rape is not explicitly recognised in the Act or the Penal Code.

Child marriage and age of marriage
Marriage (Amendment) Act No. 13 of 2023; Children’s Code Act, 2022

Gaps: Implementation and prosecution remain weak.

Termination of Pregnancy Act, 1972; Penal Code amendment of 2005
Allows abortion where continuing the pregnancy risks the woman’s life or health or that of her existing children, or where there is substantial risk of fetal abnormality; the 2005 Penal Code amendment added pregnancy resulting from rape or defilement.
Gaps: The CEDAW Committee recommended raising awareness that the law permits safe abortion and improving post-abortion care.
Political participation and quotas
Constitution of Zambia (Amendment) Act No. 7 of 2025
Created 20 proportional-representation seats for women (plus 15 for youth and 5 for persons with disabilities) and expanded constituencies from 156 to 211, applied for the first time in the 13 August 2026 elections.
Gaps: Civil society criticised the limited consultation and the small number of reserved seats.
Online violence and cybercrime
Cyber Crimes Act No. 4 of 2025; Cyber Security Act No. 3 of 2025 (both signed 8 April 2025)
Creates offences for harassment and deceptive electronic communications and grants surveillance powers.
Gaps: Civil society criticises vague definitions and excessive surveillance powers; the Act was used to arrest opposition leaders in early 2026.

Governs divorce and judicial separation for statutory marriages. It also governs related property and custody disputes.
Female genital mutilation
Children’s Code Act No. 12 of 2022
Prohibits female genital mutilation and other discriminatory cultural practices affecting children.
Gaps: Adult women are not covered by this child-focused prohibition.
Harmful practices
Penal Code, Chapter 87, section 157
Criminalises harmful cultural practices including sexual cleansing of widows.
Inheritance and succession
Intestate Succession Act, Chapter 59
Sets shares of an intestate estate for the surviving spouse, children, parents and dependants and penalises property grabbing.
Gaps: The State reports that women’s inheritance rights still face obstacles in practice.
Land and property
Lands Act, Chapter 184, implemented through the National Lands Policy 2019
Regulates land administration; the 2019 policy sets a target of allocating 50 percent of land to women.
Gaps: Women held 34 percent of allocations by December 2023, below the 50 percent target.
Abortion and sexual and reproductive health
National Health Insurance Act No. 2 of 2018
Establishes national health insurance to provide universal access to quality insured health services, including maternal care.
Girls’ education
Education Act No. 23 of 2011
Sections 17 and 18 prohibit marrying a learner and require school attendance; the 1997 re-entry policy allows pregnant girls to return, with readmissions rising from 7,391 in 2014 to 16,934 in 2024.
Gaps: Re-entry rests on policy and is not written into statute.
Labour and maternity
Employment Code Act No. 3 of 2019
Grants 14 weeks of maternity leave (section 41) and prohibits dismissal on grounds of pregnancy (section 43). It also bans discrimination in employment.
Social protection
National Pension Scheme (Amendment) Act No. 20 of 2022
Provides pension benefits on equal terms for women and men; Statutory Instrument No. 72 of 2019 extends the scheme to the informal sector with maternity benefits.
Trafficking
Anti-Human Trafficking Act, as amended by Act No. 16 of 2022
Criminalises trafficking in persons and establishes an Anti-Human Trafficking Department to investigate and prosecute. The Department also coordinates prevention.
Access to justice and legal aid
Legal Aid Act No. 1 of 2021
Provides civil and criminal legal aid to indigent persons, complemented by the National Legal Aid Clinic for Women.

Penal Code, Chapter 87, sections 155, 156 and 158
Criminalises unnatural offences and indecent practices between persons of the same sex, with section 158 applying to women as well as men.
Gaps: Penalties reach up to 14 years of imprisonment.
